License Agreement (EULA)

This agreement is between you and Code Crafted Nexus LLC (160 Harris St, Grand Rivers, KY 42045) (“we”, “us”). It covers the MEND software for Windows and macOS and its license service (“MEND”). By installing, activating or using MEND you agree to it. If you do not agree, do not use MEND, and see our refund policy.

1. Your license

When you buy a license key, we give you a personal, non-exclusive, non-transferable right to install and use MEND on one (1) Windows or Mac computer that you own or control, at a time. The key does not expire. Your license covers reasonable updates released for the same major version, as described in our terms of sale.

You may move your license to another computer by choosing Settings → License → Deactivate this computer in MEND, then activating on the new computer, or by asking support. You may not share your key or use it on more than one computer at once.

2. Activation and license checks

MEND needs an internet connection to activate. It then checks your key with our license server at start-up and about every 12 hours, and keeps working for up to 30 days without a successful check. What is sent is listed on What MEND sends and stores. If a key is refunded, charged back, reported lost or stolen, or used against this agreement, we may disable it, and MEND will lock at its next check.

3. What you may not do

• Copy, sell, rent, lease, sublicense or distribute MEND or your key, except as section 1 allows.
• Reverse engineer, decompile or disassemble MEND, except where the law says you may despite this restriction.
• Remove, bypass or tamper with the license check, or create or use keys we did not issue to you.
• Use MEND to harm, spy on or gain access to a computer you do not own or are not authorized to repair.
• Remove copyright or branding notices.

4. MEND changes your computer, so please read this

MEND can change settings, remove files and run system repair tools. It is built to do this safely: it explains each fix before it runs, runs it only after you approve, logs it, and makes a restore point (Windows) or snapshot (Mac) first where it can. Even so:

• Some changes cannot be undone, and MEND tells you when that is the case.
• Restore points and snapshots do not cover your personal files. Keep a backup of anything you cannot afford to lose before making system changes.
• Fixes you approve are your decision. You are responsible for reading what a fix will do.

5. What MEND is not

MEND is a diagnostic and repair tool. It is not an antivirus, firewall, or backup product. Its security checks report settings and unusual items; they cannot find or remove all malware and do not guarantee that a computer is secure. It cannot repair failed hardware. Its results, explanations and any estimates (for example, disk health or support dates) are based on information the computer reports and on our own data, which may be incomplete or out of date. When MEND suggests visiting a repair shop, that is a suggestion only.

6. Optional AI assistant

The AI assistant is optional and off until you turn it on. It uses your own Anthropic API key and your own Anthropic account. What it sends, and to whom, is described in MEND and on What MEND sends and stores. Anthropic provides that service under its own terms, which you accept separately, and bills you directly; we are not a party to that relationship and are not responsible for it. AI suggestions can be wrong. They never run on their own: you review and approve every fix, and you should not approve one you do not understand.

7. Updates

MEND does not update itself. We may release new versions that you can download when you choose. Updates are free: your license covers reasonable updates released for the same major version (for example, every 1.x release).

8. Ownership

MEND is licensed, not sold. We and our licensors own it and all rights in it, including the name MEND and its logo. You own your computer and your data; we claim no rights to them. MEND includes open-source software, listed with its licenses on our third-party notices page. Those licenses apply to those parts.

9. Support

Email support@codecraftednexusllc.com. We will make reasonable efforts to help with installing, activating and using MEND.

10. Disclaimer of warranties

To the fullest extent the law allows, MEND is provided “as is” and “as available”. We make no promise that it will find or fix every problem, work on every computer or configuration, or run without interruption or error. We disclaim all other warranties, express or implied, including those of merchantability, fitness for a particular purpose and non-infringement. Some places do not allow some of these exclusions, so some may not apply to you, and you keep any rights the law gives you that cannot be waived.

11. Limit of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or lost business, arising from MEND or this agreement, even if we were told they were possible. Our total liability for all claims relating to MEND will not exceed the amount you paid for MEND in the 12 months before the claim. Nothing in this agreement limits liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.

12. Ending this agreement

You can stop at any time by uninstalling MEND and deactivating your key. We may end your license if you materially break this agreement and do not fix it within a reasonable time after we tell you (or immediately where the breach is serious, such as tampering with the license check). On ending, you must stop using MEND. Sections 3, 8, 10, 11 and 13 continue.

13. General

• Governing law. This agreement is governed by the laws of the Commonwealth of Kentucky and the United States, without regard to conflict-of-law rules. If you are a consumer, you keep the protections of the mandatory laws of the place where you live.
• Changes. We may update this agreement for future versions. We will post the new date here, and a change will not take away rights you already have in a version you bought.
• If part is unenforceable, the rest still applies. If we do not enforce a right, we have not given it up.
• Transfer. We may transfer this agreement as part of a sale of our business. You may not transfer yours except by moving your license under section 1.
• Whole agreement. This agreement, our terms of sale and our privacy policy are the whole agreement about MEND.
• Export. You must follow the export and sanctions laws that apply to you.
